It is a daily routine that everyone has to work to support their families both financially and socially. I am one of those people who also want to support my family and I decided to go abroad and earn money and I got landed up in Kuwait.
Like normal formalities everyone does, i.e. signing a contract/agreement with sponsor.
Now the real fun starts here, if your sponsor is good enough you will be working fine without any problem and life looks easy. But in my case, the sponsor was giving me a very tough time like not giving salary on time, forcing me to work for late hours for no overtime pay, threatening me that he will destroy my career if I do not listen to him; in short totally mental harassment to make me work as per his order. Rather he was expecting me to dance at his tune. With total ignorance of contract which is a valid document in the court of law if there is any dispute arise at a later stage. He was least bothered about the contract and law of the land which is normally every individual should respect. Law is always above the individual and we learnt to respect the same. But in my case I was the one who was going as per contract and he was not willing to honor the contractual conditions.
I have been through a tough phase with my sponsor where he was not providing me healthy environment to deliver the productive result nor, he allowed me to find another job where I can even change my sponsor. But he used all his malicious tricks to ruin my career and to demoralize me to ensure I am totally disturbed mentally, physically, financially and socially as well. This way I was about to lose all my hopes and my guts, but I did not let it happen. My confidence factor and positive thinking was dominating factor over my sponsor’s devil tricks. Here I decided to open the trunk of my patience and put all my collective efforts to overcome the situation.
Every country has law and order. Therefore, absolutely there is no reason to be worried simply because you are an emigrant or expatriate. Every problem has solution but what is important is you need to be a little brave and mentally strong to handle the situation. There are some legal consultants and experts who are always more than happy to assist us in this type of situation. You only need to keep spreading the words amongst the circle of people whom you get along with no matter social, friend circle, or on religious platform. Ray of hopes generates only when you lighten up a small candle.
I am sure I am not the only one who has faced this situation; there are many more like me who are going through this unfair and torture situation in their day-to-day life. But my dear brothers, sisters and well wishers do not worry; this is why I am writing this article to tell you how to overcome from such a problematic situation and break all the barriers, threats and warnings which most of us are afraid of.
I started analyzing my weakness and finding the solution for the same by consulting well wisher, sharing the opinion of expert and seniors. Gradually I started gaining back my confidence and reached to level of satisfaction where I stood firm with confidence in myself. The things which I have followed I would like to share it with all of you and I hope this will help a lot of those who are facing the same issues.
- First and the most important thing is to do enough savings and prepare your mind and sue your sponsor.
- Have a good friend circle that can support you from time-to-time to overcome such situations, my main concern is not to rely on anybody or expect from anybody anything or everything but at least find someone who can help you in a way that you should be able to survive & uplift your moral.
- Approach the Indian Embassy and seek the advice. The moment you leave the company, on the very same day lodge the complaint against your sponsor in Ministry of Labor and Social Affairs (Shoun). Remember do not let your sponsor know that you are going against him/her. Otherwise you will find yourself in a big trouble. The Shoun will give you dates for hearing, do not miss any date.
- Now the sponsor cannot file any sort of complaint against you because you already have filed a case against your sponsor.
- Most probably the case gets solved in Shoun itself, but in my case, it took me two (2) months in Shoun and finally my sponsor came toShoun office and agreed to send me back to my country in front of Shoun officer, but when I asked the Shoun officer to let my sponsor handover my passport, Shoun officer spoke to my sponsor over the phone and my sponsor refused to give it back to me. In this case I seek the advice from Indian Embassy. They said to approach Labor Court and register a complaint to claim your passport.
- Do not worry it will not cost you much but it is necessary to take this step. It cost me KWD 20/- to lodge a case against my sponsor. Now, I just have to wait and watch until the court handovers me my passport.
- I was also in a situation where my visa is about to expired during the case hearings. So I seeked a legal advice from a Lawyer, he advised me to submit a Letter of Request into the court mentioning about my visa will be expired in few weeks time and I am not capable of paying any penalties as I am jobless and I just wanted go back to my family. This advised helped me a lot.
- If your sponsor still refuses to give your passport then you have to lodge a complaint in your local area police station against your sponsor mentioning everything in the report about since day one to the present date. And the police will arrest him and the sponsor has to handover your passport for sure.
Indian consulate will play a role for advice only but firm decision should come out only from you. Everything happens for good and it is just a matter of time where everything gets resolved as time progress. In my tough time I approached the following:

If you are not in fault then law will give you full support to protect your rights and justice prevails irrespective you are emigrant or local.
Last but not least I would request every person before joining any firm take proper advise from the employees currently working in that company or should know whether the company has a good fame in the market or not, which shall save you from getting into any difficulties after joining it.
